Hire Terms and Conditions |
| 1. |
Upon confirmation of a booking, 50% of the total hiring charge is required as deposit. Balance must be made in the form of cash or cheque before the deadline indicated. Under no circumstances should the confirmed order be cancelled except inevitable factors such as war or government law. No cancellation is allowed due to rainy weather. |
| 2. |
The length of the renting time will be measured exactly according to the contract. During the voyage, if the hirer wants to return earlier, no compensation will be made for the remaining time left. If additional hours are required, the owner will decide the case based on the time and the overall operation schedule at the moment, and reserves the right to refuse. If there is no negotiation about the payment for additional hours in advance, the payment will be calculated based on the ratio of the rental and time in the contract.

In the absence of the hirer for more than two hours after the fixed departure time without any reason to inform the owner, the booking is deemed as automatic cancellation, and no refund will be made to the hirer. |
| 4. |
The number of passengers stated cannot be exceeded. The coxswain reserves the right to refuse extra boarding passengers. The shipping line is restricted within the waters of Hong Kong only. |
| 5. |
In case of the foul weather or for the safe reason, the owner has the right to choose the safety line and port for landing.

| 6. |
The renting time will be calculated from the time when the vessel is at the port including the time waiting for the boarding position, and ends when all the passengers get off with all their belongings. |
| 7. |
The hirer is liable to the damage of the vessel facilities by his/her companions. The equipments should be operated only by the authorized personnel to the instruction of the user's manual. The hirer should bear all the responsibilities financially and legally for the damage of the equipments or the casualties caused by their violation operation. |
| 8. |
In case of engine failure or unexpected operation hazards before the launch, the owner will notify the hirer immediately for postponement or replacement with other vessels of the same class or refund of the full payment. No compensation of any kind will be made for any reason. |
| 9. |
If engine fails during the launch, passengers will be taken back to the nearest pier with best possible arrangement. If half of the hiring hours have been fulfilled or the vessel has reached its destination, no compensation will be made. Refund on a pro rata basis or an alternate service day would be made at the discretion of the owner. |
| 10. |
Although the owner has purchased the relevant insurances in relation with the Hong Kong laws, passengers should take care of their belongings themselves. The owner is not liable to the case of larceny but will help the passenger concerned call for the police. However, if any accident happens due to the carelessness of the owner and causes any injury to the passengers, the hirer can claim for a compensation for the loss according to the articles of the insurances. |

Agreement Concerning Cases of Weather and Typhoon: |
| a) |
If Typhoon signal No.1 or red rainstorm signal is hoisted before the launch time; or 2 hours before the launch time, higher Typhoon signal is reduced to Typhoon signal No.1 or black rainstorm changes to red rainstorm, the launch has to be resumed. During this period, the hirer should keep close contact with the owner. Postponement is allowed at this period. However, the new departure date and time will be decided based on the owner's operation schedule. |
| b) |
If typhoon signal No.3 and black rainstorm signal is hoisted during the launch, according to the Regulation of Sailing and for the safety reason, the coxswain will have to take the hirer back to the pier immediately. No refund or time compensation will be made.

| c) |
Upon hoisting of typhoon signal No.3 or higher and black rainstorm signal within 2 hours before the launch, the launch service will be automatically postponed to another weekday that is available. The hirer should bring the receipt to the owner's office for endorsement within one week, or it will be nullified and no refund will be made.

| d) |
If vessels cannot pick up passengers at the designated pier and has to change temporarily to another pier, the hirer should follow the directory of the owner to the new boarding place.

| 12. |
If cancellation or alternation of booking date occurs, food and beverage arranged have to be collected by the hirer at the pick up point and the full amount agreed must be paid.

The owner obeys the Hong Kong Laws as well as the principle of “Warm and Sincere Service; Fair and Reasonable; Reputation First”. The aim is to provide safety and smooth service.
